SHIPTU INC. CONDITIONS OF CONTRACT Definitions

On this Air Waybill, "we", "our",  "us" and Shiptu Inc.or Shiptu.com refer to Shiptu Inc. (the "carrier"), its subsidiaries  and their employees, agents, and independent contractors. "You" and "your"  refer to the shipper, its employees, principals, and agents.  "Package" means any container or envelope  that is accepted by us for delivery. "Shipment" means all packages which are  tendered to and accepted by us on a single Air Waybill.

Terms of agreement

When you give us your shipment to  deliver, you agree to all terms in this non-negotiable Air Waybill.

Your obligations

You are responsible for  adequately describing each article in this shipment and for accurately  completing this Air Waybill and any export documents, acceptable for transport  by us and properly marked, addressed and packed to ensure safe transportation  with ordinary care in handling. You are responsible for all charges, including  transportation charges and all duties, customs assessments,  governmental penalties and fines, taxes and our legal costs related to this  shipment.

Prohibited by Law

No service shall be rendered by the  carrier in the transportation of any shipment which is prohibited by law or  regulation of any federal, state, provincial, or local government in the origin  or destination countries.

Qualified acceptance

We reserve the right to reject your  shipment after acceptance and prior to performance of any part of the  transportation services, when such shipment might cause damage or delay to  other shipments, equipment or personnel. All items tendered for air  transportation are subject to aviation security controls by air carriers and  when appropriate, other government regulations, copies of all relevant shipping  documents showing the shipment consignee, consignor, description, and other  relevant data will be retained on file until the shipment completes its air  transportation.

Right of inspection

We reserve the right to open and  inspect any package tendered for transportation, at our option or at the request  of governmental authorities at any time.

Limit of liability

Unless you declare higher shipment  valuation and pay the fee, our limit of liability is the lower of the  following:
  (A) Actual value, (B) USD 150 per  shipment (or the equivalent in local currency) when lost, damaged, or otherwise  adversely affected.
  You may elect to declare a higher  shipment valuation than USD 150 per shipment by designating on this Air Waybill  the declared shipment valuation and payment of the fee, subject to the  following limits: USD 1 per USD 100 of value. In any event we will not be  liable for your acts or omissions, including but not limited to inadequate  packing, securing, marking or addressing, or for acts or omissions of the  receiver or any other party having an interest in the shipment, we will not be  liable if you or the receiver violates any terms of this agreement. We also are  not liable for loss, damage or delay caused by circumstances outside of our  control, including but not limited to, acts of god, perils of the air, weather  conditions, acts of public enemies, war, civil commotions, or acts of omissions  of public authorities, such us customs and quarantine officials who have actual  or apparent authority. We are not liable in any event for any special,  incidental, or consequential damages including but not limited to loss of  profits or loss of income, whether or not we had knowledge that such damages  might be incurred.

Declared Value Limits

The highest declared value for Shiptu Inc. package is USD 550.
  For other shipments, in  particular shipments of extraordinary value the declared value of carriage is  limited and depends on the contents and destination of the declared value  limits.
Delivery Attempts
  If  the carrier is unable to make delivery of a shipment, a non-delivery notice  will be left at the consignee's address standing that delivery has been  attempted. Thereafter, a second deliver will be made without additional charge.

Filing a claim

All  claims for reimbursement must be made in writing to us within specific time  periods after the date on which we accept the shipment, as follows:

  1. Thirty  days if it is a loss or damage claim, 
  2. One year if an overcharge  claim, and  
  3. Thirty  days if a claim for delay.
If the receiver has signed a delivery receipt  without notation of damage or loss we must also be notified at destination of  the loss or damage orally within forty-eight hours after delivery. If the  receiver accepts your shipment without noting any damage or loss on the  delivery record, we will assume that the shipment was delivered in good  condition.

The container(s) packing material and contents must  be made available for inspection at the receiver's location.
Customs Clearance
By  giving us this shipment, you herby appoint us as your agent solely for  performance of customs clearance and certify us as the nominal consignee for  the purpose of designating a custom broker to perform customs clearance.  You are responsible for and warrant your  compliance with all applicable laws, rules and regulations. You agree to  furnish such information and complete and attach to this Air Waybill such  documents as are necessary to comply with such laws, rules and regulations. We  assume no liability to you or any other person for any losses or expenses due  to your failure to comply with this provision.

Export Control
You  authorize us to act as forwarding agent for you for export control and custom  purposes. You hereby certify that all statements and information contained in  this Air Waybill and any accompanying documents relating to exportation are  true and correct.
